If You Paid a Warrant Fee and/or Failure to Appear Fee to the City of Ferguson (Missouri) You May Be Entitled to a Refund as a result of this Class Action Settlement

 

There is a proposed Settlement pending in a class action involving the warrant fee and/or failure to appear fee charged by the City of Ferguson relating to municipal court cases.

The lawsuit is called Roelif Carter v City of Ferguson and it is in the Circuit Court for St. Louis County, Missouri, Cause No. 14SL-CC004195.  It alleges that a “Warrant Fee” and a “Failure to Appear Fee” charged by the City of Ferguson Municipal Court were illegal.  The City of Ferguson asserts the warrant fee and failure to appear fee were legal. Both parties negotiated this settlement because they believe that the settlement is fair, adequate and reasonable. This settlement avoids the cost of future litigation and provides meaningful relief to the class.

If this settlement is approved by the Court, each class member who has filed a valid claim for a refund of the Warrant Fee and/or Failure to Appear Fee will receive a refund of up to 80% of each warrant fee and failure to appear fee paid to the City of Ferguson from December 9, 2009, until the present. Such refund may be reduced by certain credits.
